Terms and Conditions

Please read these incentive promotion rules carefully. These incentive promotion rules (“rules”) explain your rights and duties in connection with this incentive promotion. If you participate in this incentive promotion or accept any prize, these rules will be applicable to you. You agree that the Promoter can assume that you have read, and have agreed to be legally bound to these incentive promotion rules.

1. Introduction

AutoX (Pty) Ltd is running an incentive promotion. All participating fitment centres stand a chance to win 1 (one) of 12 (twelve) tickets to the 2021 Oktoberfest in Munich, Germany.

2. Definitions

2.1 “Brand” means Willard and or Sabat.
2.2 “Fitment centre” means all official and registered qualifying fitment centres which purchase Willard and SABAT Batteries, including the following retail fitment channels:
2.2.1 Supa Quick
2.2.2 Tyremart
2.2.3 Best Drive
2.2.4 Hi-Q
2.2.5 Dunlop Zone
2.2.6 Point S
2.2.7 Other groups
2.3 “Owner” means the Owner and/or Director and/or Shareholder of the fitment centre or group of fitment centres.
2.4 “Participant” means the person who enters his or her business i.e. fitment centre(s) to participate and compete for winning a ticket for the incentive promotion.
2.5 “Promoter” means AutoX (Pty) Ltd or its agencies used to promote this incentive promotion.
2.6 “Incentive promotion” means the completion of an entry, whereby the entrant stand a chance to win 1 (one) of 12 (twelve) prizes to the 2021 Oktoberfest incentive trip in Munich, Germany.
2.7 “Units” means Willard and Sabat batteries purchased from AutoX.

3. How this incentive promotion works?

3.1 Participants have to register and give their consent for this incentive promotion by completing the online emailer, which will be sent on behalf of AutoX Pty (Ltd), or by visiting https://auto-x.co.za/oktoberfest-2020-incentive-trip/. Once registered for this incentive promotion, participants will receive a confirmation email.
3.2 All participants must have an active trading account with AutoX Pty (Ltd) prior to the incentive promotion start date, this being the 1 February 2020. In the case where an account does not exist at the time of the incentive promotion start date, participants have until 28 February 2020 to open an active and approved trading account with AutoX Pty (Ltd).
3.3 All new trading accounts opened during the month of February 2020 can register and qualify to participate in this incentive promotion. The qualifying criteria to participate in the incentive promotion for newly opened accounts will be based on a minimum of 15 (fifteen batteries) sold per month. Should there be any questions, these are to be discussed with the account holder.
3.4 All trading accounts during the incentive promotional period will have to comply with AutoX (Pty) Ltd standard trading terms and conditions.
3.5 All participants will be categorised into 1 of 4 categories, these being based on average automotive batteries purchased per month from AutoX Pty (Ltd), during the period from 1 February to 28 February 2021. Please note that the months March and April 2020 will be excluded from this date period.
3.5.1 Hofbrau category – Greater than 50 automotive batteries per month
3.5.2 Lowenbrau category – Between 30 and 49 automotive batteries per month
3.5.3 Spaten category – Between 15 and 29 automotive batteries per month
3.5.4 Weinzelt category – New accounts opened during the month of February, based on sales performance, with a qualifying minimum base of 15 automotive batteries sold per month for the 6 month duration of the incentive promotion.
3.6 AutoX will confirm in which category the respective participant will be entered.
3.7 There will be 3 winners from each of the 4 categories, therefore totalling twelve winners.

4. Duration

4.1 The incentive promotion period will run from the 1 February 2020 to 28 February 2021.
4.2 Any purchases, or other qualifying criteria, after the incentive promotion period end date will not be considered.

5. Incentive promotion winner announcement dates:

Each of the twelve winners will be notified in writing by no later than 14 August 2021. The Promoter reserves the right to extend the incentive promotion or change the announcement dates. Notice of any changes will be posted in these rules.

6. Prizes:

6.1 Each winner will receive a prize which includes the following:
6.1.1 An economy return flight on Turkish Airlines from OR Tambo International Airport in Johannesburg, Gauteng to Munich International Airport in Munich, Germany. Travel arrangements to and from OR Tambo International Airport will be handled on an individual basis, depending on the location of the winner.
6.1.2 Six (6) night accommodation in a 4-star single room in the Eden Hotel, Wolff, Munich which also includes breakfast;
6.1.3 Several excursions and dinners, including 2-day access tickets to the Oktoberfest.
6.1.4 Winners must be available to travel during specific dates. These dates that will be shared at a later stage. If the winner is unable to travel on these dates, the prize will be forfeited.
6.1.5 The prizes are not transferable.

7. Eligibility:

7.1 The incentive promotion is open to all qualifying fitment centre owners or shareholders, aged 18 years or over with a valid passport.
7.2 The winners’ passport needs to be valid until the 15 April 2022. The winners’ passport needs to have a minimum of 5 blank/open pages in order for travel and visa stamps.
7.3 The winner must be able to obtain a valid Schengen Visa for the period.

8. Is there a limit on the number of times you can enter?

Entries are limited to the owner of the applicable fitment centre. Should the owner own multiple fitment centres, the owner will be limited to one prize as the same owner can’t qualify to win more than one ticket.

9. How will the winner be chosen?

The winner will be selected based on the following criteria:

The 3 winners per category will be selected based on the predetermined criteria.

In the case where a fitment centre had a name change or opened a new trading account with
AutoX, the sales linked to both accounts will be taken into account.

10. How will the winner be notified?

10.1 The winner will be contacted telephonically and in writing within 14 days after the incentive promotion draws to an end i.e. the 28 February 2021.
10.2 Any changes to the arrangements or incentive promotion Terms and Conditions will be updated and available on https://auto-x.co.za/oktoberfest-2020-incentive-trip/.

11. General

11.1 The Promoter’s decision is final. No correspondence will be entered into.
11.2 The Promoter, and any of the rewards companies, reserve the right to disqualify any claim/entry if fraud, cheating or manipulation is suspected, including without limitation, through the manipulation of sales figures, code or otherwise falsifying data.
11.3 If the incentive promotion prize(s) are not available, despite the Promoter’s reasonable endeavours to procure the prize, the Promoter reserves the right to substitute the prize of equal value.
11.4 Any personal data relating to the winners, or any other entrants, will be used solely in accordance with current data protection legislation, and will not be disclosed to a third party without the entrant’s prior consent.
11.5 AutoX (Pty) Ltd will retain the information of the incentive promotion for a period of at least three (3) years.

11.7 South African law governs this incentive promotion.
11.8 The Participants acknowledge and agree that in order to enter the incentive promotion; the promoter must collect and use personal information about the participants. Any Personal Information will be used solely in accordance with current personal data protection legislation and will not be disclosed to a third party without the participant’s’ prior consent.

IMPORTANT NOTICE:

You agree to indemnify the Promoter fully for any loss or damage the Promoter may suffer in the event you are in breach of the incentive promotion rules.
Under this entire clause “indemnify” means you agree to reimburse the Promoter for the following: any loss or damage they suffer, any expenses and costs they paid or are responsible for. Legal costs means costs on an attorney and own client scale.
You also agree to indemnify the Promoter for any loss or damage you suffered because you took part in this incentive promotion or used the prize. If you enter the incentive promotion, or use or accept the prize, you understand that you do so of your own free will. This means that you cannot hold the Promoter legally responsible for any loss or damage or legal expenses you suffer because you took part in this incentive promotion or used the prize.
You furthermore agree to indemnify the Promoter fully for any loss, damage, claim, or injury that may occur because of the use of the prize or your inability to use the prize for any reason. This includes, but is not limited to, injury, loss, death or financial damages caused to any person other than yourself.
You therefore agree that you cannot hold the Promoter legally responsible for any loss or damage or legal expenses or medical expenses you suffered caused because you used the prize.
You will protect the Promoter from being held legally responsible for the loss or damage or legal expenses of another person (legal or natural) if such loss or damage or expense was incurred because:

    1. You breached the incentive promotion rules;
    2. You took part in this incentive promotion; and/or
    3. You or any person used a prize.
